By accessing or using www.the-adverse.com, you agree to be bound by these Terms of Service. These terms apply to all visitors and clients. If you do not agree, do not use this site.
Tula M. & Co LLC (DBA The Adverse / ADV) provides AI-assisted creative production services including product imagery, lifestyle visuals, video production, and related deliverables as outlined in individual client agreements.
Payments are processed via Stripe or bank transfer as agreed upon in your service agreement. All fees are outlined prior to project commencement. Deposits, where applicable, are non-refundable once production has begun.
The AI Production Partner retainer operates on a month-to-month basis. A 30-day written notice is required to cancel. Notice must be sent to hello@the-adverse.com. Cancellation does not entitle the client to a refund for the current billing period.
Upon receipt of full payment, all deliverables produced for the client become the sole property of the client. Full copyright transfers to the client at that point. The Adverse retains no licensing rights over delivered assets. We reserve the right to use anonymized or unbranded production samples in our own portfolio unless explicitly agreed otherwise in writing.
We make every effort to ensure product accuracy across all deliverables. Revision rounds are included as specified in your service agreement. We do not guarantee specific business outcomes from creative assets produced.
To the fullest extent permitted by law, Tula M. & Co LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the amount paid by the client in the 30 days preceding the claim.
These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.
We reserve the right to update these terms at any time. Continued use of our services constitutes acceptance.
